In accordance with 44 CFR §9.8 for Executive Orders 11988 & 11990 New Albion Lake Culvert Replacement Project
New Albion, Cattaraugus County, New York

Notification is hereby given to the public of the intent of the Department of Homeland Security-Federal Emergency Management Agency (DHS-FEMA) to provide federal funding to Cattaraugus County as subrecipient for the removal and replacement of three (3) existing culverts to prevent overtopping of water, shoulder erosion, and debris and sediment backups during storm events in New Albion, Cattaraugus County, New York through the Hazard Mitigation Grant Program (HMGP). The purpose of HMGP is for communities to develop hazard mitigation plans and rebuild in a way that reduces, or mitigates, future disaster losses. This notification is given in accordance with Executive Order (EO) 11988 (Floodplain Management), EO 11990 (Wetlands Protection), 44 CFR Part 9, regulations for implementing EOs 11988 & 11990, and the National Historic Preservation Act (NHPA).

The project is to be located along County Road No 5 / Mosher Hollow Road at the following locations: Culvert #1 (42.30488, -78.91400), Culvert #2 (42.30362, -78.91195), and Culvert #3 (42.29871, -78.90421). The proposed scope of work is to upgrade three (3) existing culverts, which currently have insufficient capacity for stormwater flows, with new culverts capable of alleviating roadside damage and shoulder erosion caused by repetitive overtopping of water.

This action would take place within the 100-year floodplain and mapped wetlands. Alternatives considered include: 1) no action or 2) the proposed alternative to upgrade three (3) existing culverts. FEMA has determined that removing and replacing the existing culverts is the best alternative to prevent further erosion and overtopping of water to the existing shoulder and roadways. Potential floodplain and wetland impacts are anticipated to be temporary during construction and minimized through best management practices and conservation measures incorporated from resource agency recommendations and required regulatory permits.

If substantive comments are received, FEMA will evaluate and address the comments as part of the environmental documentation for this project.
